The Inter-Agency Council Against Child Pornography (IACACP)

The Republic Act 9775 or Anti-Child Pornography Act of 2009 under Section 20 mandated the creation of the Inter-Agency Council Against Child Pornography (IACACP).  The IACACP is mandated as the body to coordinate, monitor and oversee the implementation of the law. Said Council shall compose of the Secretary of the DSWD as the chairperson and the following as members:

  3. Department of Science and Technology
  4. Philippine National Police
  5. Commission of Human Rights
  6. Commission on Information and Communications Technology now Information and Communications Technology Office
  7. National Telecommunications Commission
  8. Council for the Welfare of Children
  9. Philippine Center for Transnational Crimes
  10. Optical Media Board
  11. National Bureau of Investigation

 

Section 20 (l) of the law states that members of the Council should include three (3) representatives from children’s non-government organizations. These representatives shall be nominated by the government agency representatives of the Council for appointment by the President for a term of three (3) years and may be renewed upon renomination and reappointment by the Council and the President, respectively.

 

  1. II.     Framework of Operation

 

This Three-Year Strategic Plan is based on the outputs of the planning workshop and the mandate of IACACP as provided in the Act and its implementing rules and regulations.  It identifies five (5) key strategic areas for the effective implementation of the Act and to achieve the goal of eradicating child pornography: (1) Advocacy, (2) Enforcement, Investigation and Prosecution, (3) Victims Assistance and Support, (4) Monitoring and Management Information System, and (5) Partnership and Resource Management.

To increase public awareness of the problem of child pornography and educate the public on the anti-child pornography law

  1. To enhance the knowledge base on the phenomenon of child pornography in the Philippines
  2. To develop and implement a systematic information dissemination campaign on the issue of child pornography and Republic Act No. 9775.
  3. To develop information, education, and communication (IEC) materials on child pornography and Republic Act No. 9775.
  4. To conduct massive advocacy campaigns in high risk communities on online pornography and cyber sex involving children, including parent education on supervising children in the use of the internet.
Enforcement, Investigation and Prosecution Lead: Department of Justice, National Bureau of Investigation and Philippine National Police Members: Philippine Center on Transnational Crime, Optical Media Board, an NGO and Secretariat and DSWD Legal Service

 

To strengthen the enforcement of the law and effectively investigate and prosecute offenders.

  1. Coordinate with the Department of Justice in the appointment of special prosecutors to handle child pornography cases
  2. Enhance the capacity of law enforcers and prosecutors to investigate and prosecute child pornography cases through continuing education.
  3. Ensure the immediate investigation and prosecution of persons for violation of Republic Act No. 9775 in accordance with the Rules of Criminal Procedure and other applicable laws, rules, and regulations.
  4. Strengthen the regulation of Internet Content Hosts (ICH), Internet Service Providers (ISP), and Internet Cafes or Kiosks.
  5. Advocate and coordinate with the Philippine Judicial Academy (PHILJA) to conduct training seminars for judges and court personnel on Republic Act No. 9775 and the issue of child pornography.
  6. Initiate, through the Department of Justice in coordination with the Department of Foreign Affairs, strategies for negotiations with other countries on mutual legal assistance and extradition treaties to address cases of child pornography and related crimes.
Victims Assistance and Support Lead: Department of Social Welfare and Development Members: Department of Labor and Employment, Department of Science and Technology, Commission on Human Rights, NGO and Secretariat and DSWD Program Management Bureau To effectively provide assistance and support to victims of child pornography and their families

  1. To conduct a baseline study on the effects of child pornography on the victims, their families, and their community
  2. To formulate polices and/or program standards specific to child pornography.
  3. To enhance the capacity of service providers and local social welfare offices in the delivery of mandatory services and support to victims, their families, and their communities.
  4. To establish a referral system that will coordinate the immediate response to the needs of the victims and their families

 

 

Monitoring and Management Information System Lead:National Telecommunications CommissionMembers: Information and Communications Technology Office (former CICT), Department of Science and Technology, Department of Justice, Philippine Center on Transnational Crime, an NGO and Secretariat.

 

To coordinate complaints processing, facilitate information-sharing among stakeholders, and effectively monitor the progress of cases through an institutionalized case monitoring and data management system

  1. To establish a complaints system that is accessible to the public and will ensure the immediate response of government agencies and other key actors.
  2. To establish a centralized database on child pornography activities and cases, including case status and provision of mandatory services to victims, to be shared among the concerned government agencies
Partnership and Resource Management Lead:Department of Social Welfare and DevelopmentMembers: Council for the Welfare of Children, an NGO and Secretariat To develop strategic partnerships with key stakeholders in addressing the issue of child pornography and ensure sufficient resources for the effective implementation of Republic Act No. 9775

  1. To conduct research on and inventory of the existing programs and services offered by government structures and civil society organizations that address child pornography and/or have the capacity to assist in the provision of mandatory services
  2. To collaborate with key civil society organizations in the implementation of Republic Act No. 9775
  3. To collaborate with local government units of high risk communities in the implementation of Republic Act No. 9775
  4. To ensure sufficient appropriations by concerned government agencies to fund the effective implementation of Republic Act No. 9775
  5. To generate financial assistance and support from funding agencies and the private sector for the effective implementation of IACACP’s programs and projects
